Empowering Immigrants, Strengthening America
To apply for a green card in New Jersey, you must qualify through a specific category, most commonly a family relationship, employment, or humanitarian status, and complete a multi-step process with U.S. Citizenship and Immigration Services (USCIS).
At DeCosmo Law, our immigration attorneys in Camden have helped many immigrants through each step of the green card application process, from the eligibility review to the final approval. Reach out to us to learn how we can assist with your green card application.
Who Qualifies for a Green Card in Camden?
Most applicants qualify through one of these categories:
- Family-based petitions (spouse, parent, child, or sibling of a U.S. citizen or permanent resident)
- Employment-based sponsorship
- Asylum or refugee status
- Special programs such as U visas or other humanitarian relief
In some cases, individuals may self-petition, such as certain employment-based applicants, VAWA (Violence Against Women Act) self-petitioners, or National Interest Waiver applicants, without requiring a traditional sponsor.
Filing Your Immigrant Petition
The process usually begins with a petition filed on your behalf. Some applicants may file on their own behalf if eligible.
- Family-based cases use Form I-130
- Employment-based cases may use Form I-140
This petition establishes your eligibility for a green card. Make sure to review your paperwork multiple times because errors or missing documentation at this stage can significantly delay the processing of your petition.
Waiting for Visa Availability
Some categories have waiting periods based on visa limits under federal law. Immediate relatives of U.S. citizens typically don’t face long delays, while other categories may require waiting for a visa number to become available. Immediate relatives of U.S. citizens (spouses, unmarried children under 21, and parents of U.S. citizens age 21 or older) are not subject to annual numerical visa limits, meaning visa numbers are generally immediately available.
Knowing your priority date and category is important to avoid filing too early or missing deadlines.
Applying for a Green Card in Camden Through Adjustment or Consular Processing
You can complete your application in one of two ways. Each path has different requirements, timelines, and risks:
Adjustment of Status (Form I-485)
If you are already in the U.S., you can apply for a green card without leaving the country. To qualify for adjustment of status, you must generally have been lawfully admitted or paroled into the United States, have a visa number available, and not be barred by grounds of inadmissibility unless a waiver applies.
Most applicants must also complete a medical examination by a USCIS-authorized civil surgeon and submit Form I-693 as part of the process. Family-based applicants are typically required to submit an Affidavit of Support (Form I-864) demonstrating sufficient financial sponsorship.
Consular Processing
You will complete the process through a U.S. consulate or embassy if you’re not in the U.S. During the consular interview, a consular officer determines whether you qualify for an immigrant visa and whether any grounds of inadmissibility apply under federal law.
Attending Your Biometrics Appointment and Interview
USCIS will schedule your biometrics appointment (fingerprints and background check) and interview, often at the USCIS field office serving New Jersey. Camden County residents are typically scheduled at the USCIS field office with jurisdiction over southern New Jersey, such as the Mount Laurel Field Office, although locations may change.
Waiting For The Decision
If approved, you will receive lawful permanent resident status and your green card. If USCIS requests additional evidence or denies your application, you must respond quickly or evaluate your next steps, which may include refiling or addressing legal issues.
