Federal Court Orders Immediate Release Following Major Immigration Victory by Derek DeCosmo of DeCosmo Law

Derek DeCosmo, Founder and Managing Partner of DeCosmo Law, has secured a decisive victory in Federal Court, resulting in the immediate release of an individual who was wrongfully detained despite having committed no crimes.

Derek, an experienced Immigration Attorney based in Camden, New Jersey, filed a § 2241 habeas corpus petition after his client, an aspiring medical student, was taken into custody by federal agents while on his way to school. The detention separated the client from his family and threatened his future, despite the absence of any criminal conduct.

In a clear and forceful ruling, the Federal Judge granted the petition in full, ordering that:

  • The Petitioner be immediately released under the same conditions that existed prior to detention
  • Respondents file written confirmation of the date and time of release
  • Respondents be permanently enjoined from rearresting or detaining the Petitioner under § 1225, which the Court found inapplicable
  • The case be formally closed
