Derek A. DeCosmo Appeared on NewsNation’s “Cuomo” to Discuss ICE Detention Practices and Due Process Concerns
On April 28, 2026, Derek A. DeCosmo, Managing Partner of DeCosmo Law, appeared on “Cuomo,” hosted by Chris Cuomo on NewsNation to discuss a recent immigration case raising serious concerns about due process and detention practices within the immigration system.
During the interview, Mr. DeCosmo discussed his client, Tatiana, who had been detained by U.S. Immigration and Customs Enforcement (ICE) without bail. He noted that Tatiana had never been convicted of any crime, and that her prior case had been fully dismissed. Despite this, she remained in detention while a pending application for legal permanent residence filed by her husband continued to move through the process.
Mr. DeCosmo used the segment to highlight what he described as broader systemic issues affecting immigration courts and detention decisions nationwide.
He stated:
“The standard of the law hasn’t changed, but what has changed is that the immigration court system is being used to implement political policy. One of which is the aim of the administration to not allow people they choose to detain to get out of jail. Period.”
He further added:
“Immigration judges are pretzel logicing themselves to keep people detained.”
Mr. DeCosmo also expressed concern about what he described as pressure within the system impacting judicial independence:
“The judges are afraid that if they don’t go along with the program, they’ll get fired.”
According to DeCosmo, these dynamics contribute to prolonged detention in cases where individuals have no criminal convictions and otherwise strong equities, raising significant concerns about fairness and due process protections in immigration proceedings.
